facebook pixel Prosecution case-in-chief / Direct & Cross Examination of Witnesses | Denver Criminal Defense Attorney | Denver Federal Criminal Defense Attorney Colorado

The prosecutor will present their witnesses and ask questions.  This is called direct examination.  It is improper to lead a witness during direct examination.  Leading questions are those that suggest an answer, such as: “Isn’t it true that you were home last night?”  Instead, a non-leading question should be asked, such as: “Where were you last night?”

After the prosecutor “passes” the witness, the defense attorney will be permitted to cross-examine the witness.  Leading questions are proper and encouraged on cross-examination.
